  • Voluntary Information: Your completion of the health assessment questionnaire is voluntary. By providing this information, you consent to its use by Mogu Mycro and our network of licensed healthcare professionals for the purpose of providing personalized recommendations.
  • Doctor-Patient Relationship: The licensed healthcare professionals in our network operate independently and are responsible for their medical advice and recommendations. While our platform facilitates communication, your relationship is directly with the assigned doctor. Mogu Mycro does not provide medical advice or services directly.
  • No Guarantee of Prescription: Completion of the assessment or consultation with a doctor does not guarantee a prescription or recommendation for any specific product. The doctor will exercise their professional judgment.

5. Subscription Services and E-commerce

  • Subscription Terms: If you subscribe to our services, you agree to the specific terms and conditions of your chosen subscription plan, including billing cycles, recurring charges, and cancellation policies, which will be presented to you at the time of subscription.
  • Product Purchases: All product purchases made through our e-commerce platform are subject to our separate Shipping Policy and Return Policy, which are incorporated into these Terms by reference.

MOGU MYCRO DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED. WE DO NOT WARRANT THAT THE SITE OR THE SERVER THAT MAKES IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

9. Limitation of Liability

You agree to defend, indemnify, and hold harmless Mogu Mycro, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms of Use or your use of the Site, including, but not limited to, your User Contributions, any use of the Site’s content, services, and products other than as expressly authorized in these Terms of Use or your use of any information obtained from the Site.

11. Governing Law and Jurisdiction

All matters relating to the Site and these Terms, and any dispute or claim arising therefrom or related thereto (in each case, including non-contractual disputes or claims), shall be governed by and construed in accordance with the internal laws of the State of California without giving effect to any choice or conflict of law provision or rule.

Any legal suit, action, or proceeding arising out of, or related to, these Terms or the Site shall be instituted exclusively in the federal courts of the United States or the courts of the State of Oregon, although we retain the right to bring any suit, action, or proceeding against you for breach of these Terms in your country of residence or any other relevant country. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.
